Welcome to MessageDrift. By accessing or using our platform, you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, you must not use MessageDrift.
1) Who Can Use MessageDrift
You must be at least 18 years old to create an account or leave messages. Children under 18 may access content only with the involvement and supervision of a parent or legal guardian. You must not impersonate anyone or misrepresent your identity.
2) Accounts, Subscriptions & Billing
- Accounts: You are responsible for keeping your login details secure and for all activity under your account.
- Subscriptions & Payments: Some features may require payment (e.g., subscriptions or one-off fees). Payments are processed by trusted third-party providers such as Stripe and are subject to their terms and privacy policies.
- Communications: By creating an account, you consent to receive emails or SMS messages related to verification, transactions, or account activity. You may opt out of non-essential communications at any time.
- Cancellations: You may cancel at any time via the account or billing portal. Access to paid features will continue until the end of your current billing period unless otherwise stated.
- Refunds (No Refunds): All payments to MessageDrift are final and non-refundable. No refunds or partial refunds are provided for any reason, including change of mind, accidental purchase, dissatisfaction, or unused time in a billing period. This does not limit your rights under the Australian Consumer Law (ACL). If the service fails to meet a consumer guarantee under the ACL, you may be entitled to a remedy as required by law.
3) Your Responsibilities
You agree not to:
- Post harmful, threatening, harassing, defamatory, or unlawful content.
- Share content that includes personal information of others without consent.
- Use the platform to impersonate another person or entity, or to mislead.
- Attempt to disrupt, probe, or access systems without authorization.
You are solely responsible for the content you submit. All messages are subject to moderation and may be held, edited (for formatting only), or removed if they violate these Terms or our safety standards.
4) Suspension & Termination
We may suspend or terminate your access at any time, without notice, if we believe you have violated these Terms, pose a security or legal risk, or if required by law. We are not liable for any resulting loss of data or access.
5) No Guarantee of Delivery or Permanence
MessageDrift is a memory-sharing service, not a guaranteed communication or archival platform. We do not guarantee that any message will be delivered, found, read, or stored forever.
MessageDrift does not guarantee that content or messages will be stored, backed up, or retrievable at any time. You acknowledge that technical failures, maintenance, or data corruption may result in permanent loss of content. By using the service, you waive any claims arising from loss, corruption, or unavailability of data.
6) Safety, Moderation & Filters
To protect recipients—especially children—we use automated filters to detect potentially harmful or inappropriate content. Flagged content may be held for administrator review and may be rejected or removed at our discretion. Our moderation decisions are final and not subject to appeal.
7) Intellectual Property & License to Your Content
You retain ownership of your messages and content. By submitting content, you grant MessageDrift a worldwide, non-exclusive, royalty-free license to store, host, display, and transmit that content solely for the operation of the service. You represent that you have all rights necessary to grant this license.
8) Third-Party Services
MessageDrift relies on third-party providers such as payment processors, email delivery, and cloud storage. We do not control and are not responsible for their actions, availability, or security. Your use of those services is governed by their respective terms and privacy policies.
9) Service Changes & Availability
We may add, change, suspend, or discontinue features or the service (in whole or part) at any time, including for maintenance, security, or legal reasons. We are not liable for outages, interruptions, or loss of access to content.
10) Indemnity
You agree to indemnify and hold harmless MessageDrift, its owners, officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your content, or any breach of these Terms.
11) Limitation of Liability
To the maximum extent permitted by law, MessageDrift is provided on an “as-is” and “as-available” basis. We are not liable for indirect, incidental, special, consequential, or punitive damages, including emotional distress, loss of data or messages, missed or misdelivered content, or technical failures, even if we have been advised of the possibility of such damages.
12) Governing Law
These Terms are governed by the laws of New South Wales, Australia. If you access the service from another country, you do so at your own risk and are responsible for compliance with local laws.
Nothing in these Terms limits your non-excludable rights under the Australian Consumer Law.
13) General Provisions
These Terms constitute the entire agreement between you and MessageDrift. If any provision is found invalid, the remaining terms remain enforceable. Failure to enforce any provision does not waive our right to enforce it later.
14) Updates to These Terms
We may update these Terms from time to time. Changes will take effect when posted here with a new “Last updated” date. Continued use of MessageDrift after changes means you accept the updated Terms.

16) Refund Policy (No Refunds)
All payments to MessageDrift are final and non-refundable. This includes subscription charges, one-off fees, and any other paid features. We do not offer refunds or partial refunds for change of mind, accidental purchases, dissatisfaction, or unused time within a billing period. You can cancel a subscription at any time, and you will retain access until the end of the current billing cycle.
Technical issues: If a paid feature is unavailable due to a technical failure caused by MessageDrift, we may, at our sole discretion, provide a credit or re-enable access to the purchased service. This does not constitute a cash refund.
Nothing in this Refund Policy limits your rights under the Australian Consumer Law. If the service fails to meet a consumer guarantee under the ACL, you may be entitled to a remedy as required by law.
